Petitioner objects to the situation of a petrol pump set up by respondent No.6. One of the main contention of the petitioner is that as per the policies prevailing in the relevant Act the petrol

pump had to be situated atleast 30 meter distance from the central line of highway of which it was inhabited. In the present case according to the petitioner this requirement has been breached.

The petitioner has not produced any literature in the form of guidelines issued by the oil company or the government prescribing minimum distance to be maintained from the central line of highway to the petrol pump. In any case if according to the petitioner any of the mandatory requirements for setting up of the petrol pump have been breached let the petitioner at the first instance bring these aspects to the notice of the oil company for the petrol pump. Once these factual issues are threshed out at that level if the petitioner has any other grievance which survives, it will be open to the petitioner to take recourse of the law.
