As per the condition No.4(iii) of the recruitment notification, the applicant was required to have a valid license for driving Light Motor Vehicle and Transport Vehicles with three years driving experience in both the categories. A perusal of the driving license held by the petitioner (placed on record as Annexure-7), indicates that he procured the transport vehicle driving license on 15.06.2020. Manifestly thus, the petitioner did not have three years experience of driving a Transport Vehicle in terms of the condition No.4(iii) of the recruitment notification. Hence, he was not qualified to be appointed as Chauffeur in the recruitment process in issue. The contention of Shri Bhati that the petitioner had submitted his documents before the written examination was conducted and thus, it is to be presumed that the recruiting agency must have checked the same before calling the petitioner for job test and hence, the right of the petitioner to be appointed in the selection process has been crystallized, is of no avail in view of the condition No.19(8) of the recruitment notification which reads as below:-
