This is a second round of litigation initiated by the

petitioner.

In the first round, the petitioner had filed S.B. Civil Writ Petition No.15014/2020 which came to be decided by this Court, vide order dated 09.03.2021.

This Court had directed to grant admission to the petitioner in the Academic Session 2020-2021 by creating one additional seat in any of the Government Medical College under SC Category.

The order dated 09.03.2021 passed by this Court was put to challenge before the Apex Court and the Apex Court vide order dated 20.09.2021, modified the order of this Court, granted admission to the petitioner in Government Medical College for the Academic Year 2021-2022 in SC Category.

The grievance of the petitioner is with regard to allotment of seat to him in the Government Medical College in Management quota, where fee per annum is Rs.7,85,000/-.

This Court had issued notices in the present writ petition to the respondents and asked them as why the petitioner has been given admission in Management Quota seat but not in Open quota seat.

During pendency of the writ petition, the respondents have issued a letter dated 10.03.2022, whereby, they have cancelled the earlier order of allotment of seat to the petitioner and petitioner was allotted RNT Medical College, Udaipur.

Learned counsel for the petitioner informed this Court that in pursuance of allotment letter dated 10.03.2022, the petitioner has been allowed to join the RNT Medical College, Udaipur.

This Court, considering the issuance of subsequent provisional allotment letter dated 10.03.2022, does not require to adjudicate the matter on merits and in view of subsequent development took place, the present writ petition has become infructuous.
