In pursuance to the advertisement dated 25.05.2018, the petitioners have applied for the appointment on the post of Constable.
Grievance of the petitioners is that after successful in the written test, the petitioners have participated in the physical efficiency test, however, they could not perform well due to heavy rain and muddy track and the petitioners prayed for reconducting of the physical efficiency test.
Counsel for the respondents has opposed the writ petition and submitted that the issue involved in these writ petitions has already been considered and decided by the Division Bench of this Court in the matter of State of Rajasthan & Ors. Vs. Revant Ram Meghwal & Ors, reported in 2020 (1) WLC 255 and by this court in the matter of Jugal Kishor Gurjar Vs. State of Rajasthan & Ors. (S.B. Civil Writ Petition No.5853/2022) along with other connected matters) decided on 16.08.2022.
In that view of the matter, no case is made for interference by this Court under Article 226 of the Constitution of India, in view of the judgment passed by the Division Bench of this Court in the matter of State of Rajasthan & Ors and by this Court in the matter of Jugal Kishore (both supra).
Hence, these writ petitions stand dismissed. Copy of the order be separately placed in each file.
