By way of the present writ petition a grievance has been raised by the petitioner that the respondents are denying him promotion on the post of ASI in wake of pendency of a criminal case which was registered against him after the vacancy was notified by the respondents for the post of ASI.

Mr. Sidhu, learned counsel for the petitioner submits that petitioner would feel satisfied, if the competent authority of the respondents is directed to consider his representation, expeditiously, in accordance with law including circular dated 04.06.2008.

The present writ petition is, therefore, disposed of with the direction to the petitioner to address a fresh representation before the competent authority of the respondents (respondent No.3) on or before 31.12.2022 along with photostat copy of the earlier representation and a certified copy of the order instant.

In case representation is so addressed, the competent authority shall consider the same, in accordance with law, as early as possible, preferably within a period of eight weeks from the receipt thereof and pass a speaking order. Petitioner's rights to take remedy against such order shall stand reserved.

It is made clear that aforesaid direction to decide the representation has been issued only with a view to ensure expeditious redressal of petitioner’s grievance. The same may not be construed to be an order to decide the representation in a particular manner.

The stay application also stands disposed of accordingly.
