Counsel appearing on behalf of the Corporation has filed the additional affidavit wherein para No.4, it has stated as under:-

“That in addition to the above amount respondent workman is also entitled for 1282 Double Duty rest allowances

Rs.6,51,619/-. Therefore the total amount payable is – 6,51,619+31,469 =6,82,088/only.”

Counsel for the workman on instructions received from the workman does not dispute the amount as mentioned above being the outstanding amount, however submits that in view of the award of the Labour Court dated 05.02.2019 the workman is also entitled for interest @9% per annum on the outstanding amount and therefore prayed that the Corporation be directed to pay the outstanding amount along with interest @9% per annum thereon, from the date of the Award dated 05.02.2019.

In that view of the matter, these writ petitions stand disposed of with direction to the Corporation to pay the admitted outstanding amount of Rs.6,82,088/- to the workman along with interest @9% per annum thereon, from the date of passing of the award dated 05.02.2019. In the terms indicated above, the award of the Labour Court dated 05.02.2019 stands modified accordingly. Compliance of the order be made within a period of three months.
