Nawal Kishor Modi Son of Late Shri Ghanshyamdas Modi Vs Santosh Sain Wife of Late Shri Nanagram Sain

This writ petition under Article 227 of the Constitution of India has been filed seeking a direction for speedy trial of the civil suit no.216/2016 “Nawal Kishore Vs. Santosh Sain“ pending in the court of learned Additional Senior Civil Judge, No.2 Neem Ka Thana, District Sikar.

Learned counsel for the petitioner submits that the aforesaid suit filed by him seeking eviction, arrears of rent and mesne profit is pending consideration for more than 7 years. She prays that the learned trial Court may be directed to decide it expeditiously.

In view of the limited prayer made by the learned counsel for the petitioner, this writ petition is being disposed of in following terms without issuing notice to the respondent.

Taking into consideration the contentions advanced by learned counsel for the petitioner and the material on the record,

this court deems it just and proper to request the learned trial Court to expedite hearing and disposal of the civil suit No.216/2016 “Nawal Kishore Vs. Santosh Sain”.
