Learned counsel for the respondent no.1 submits that the writ petition is rendered infructuous inasmuch as after remand, the District Collector, Jaipur, has dismissed the application filed by the petitioner-appellant under Section 96 CPC seeking leave to prefer an appeal.
Learned counsel for the petitioner did not dispute the aforesaid submission.
In view thereof, the writ petition is dismissed as infructuous.
