The present writ petition has been filed with the following

prayers:-

a). That the respondent may be directed to make payment of outstanding salary of the petitioner as mention in para no.4 of the writ along with 18% interest.

b). That the respondent may be directed to make payment of outstanding retiral benefits including PF Gratuity and other benefits along with 18% interest.

c). That the petitioner may also be awarded an appropriate penal interest over the amount and adequate compensation.

A reply has been filed on behalf of respondent Nos.2 & 3, annexing a communication issued by the Co-operative Society with which the petitioner was working. A perusal of the said communication clarifies that the amount qua the salary, gratuity, earned leaves and the PF contribution of the society along with the payable interest has already been paid to the petitioner. A receipt of the said amount according complete satisfaction qua the payment has also been placed on record.

Learned counsel for the petitioner does not dispute the above mentioned fact however, submits that the amount qua his PF contribution deducted from his salary till the year 1991 which remains deposited with the PF department has not paid to him till date.

Learned counsel appearing for the PF Department specifically submits that the Department is ready to pay the said amount.

In view of the submission made, respondent No.5 is directed to pay the PF amount of the petitioner deducted from his salary (i.e. the amount deposited qua the contribution of the petitioner till 30.06.1991) to the petitioner with interest in terms of law within a period of four weeks from the date of the receipt of certified copy of the present order.

With the above observations, the present writ petition is disposed of.

All the pending applications also stand disposed of.
