alongwith other persons are khatedar co-sharers of a khata, wherein khasra nos. 693, 694 and about 65 other khasra numbers have been mentioned, which is known as 'Pana Ki Shamlati Bot'. By way of mutual partition, land of khasra no. 693 came in the share of plaintiffs and land of khasra no. 694 came in the share of defendants and all the khatedar co-sharers got constructed the house and ' bada ' on the land which came in their share. In order to pass through the agricultural fields of one another, they left the land in their respective khasra number. It was also pleaded that plaintiffs' houses are situated in the western side of the defendants' houses and in order to go there, way passes through Chamro wali Johadi, land of khasra no. 663 and land of khasra no. 664 which is in the northern side of the defendants' plot in khasra no. 694 and then it reaches to the northern eastern corner of plot of khasra no. 693. In between khasra nos. 693 and 694, the plaintiffs and defendants left 20 X 12 ft. land for the way, which is being used by them for the past about 25 years for ingress and outgress and the plaintiffs have easement of necessity for the same, but the defendants put dry sticks and laid bricks and stones and closed the said way.
