Heard. Perused the material available on record.
The District Level Parole Advisory Committee, Udaipur in its meeting held on 14.10.2022 has granted sixth regular parole of 40 days to the convict-petitioner Ram Singh S/o Shri Girjidan @ Girwardan with the condition of furnishing a personal bond of Rs.1,00,000/- and two sureties in the sum of Rs.50,000/- each. The convict-petitioner has approached this Court seeking a direction for waiver of the condition of furnishing surety bonds on the ground that his family is facing abject poverty and no one is available to furnish the surety bonds on his behalf.

Learned AAG Shri Joshi has furnished the factual report as per which, the petitioner had satisfactorily availed third, fourth and fifth paroles on furnishing personal bonds only. It is not in dispute that the conduct of the petitioner during the prior periods of paroles was satisfactory and he surrendered back in the prison after availing facility of parole.
Having regard to the overall facts and circumstances of the case and considering that by effect of orders passed in D.B. Criminal Writ Petition Nos.243/2018, 543/2019 and 291/2021, the petitioner has satisfactorily availed third, fourth and fifth parole facilities without any complaint whatsoever on furnishing personal bonds, we deem it proper to release him on sixth regular parole of forty days by waiving the condition of furnishing two surety bonds as imposed by the District Parole Advisory Committee, Udaipur and it is directed that the convict petitioner Ram Singh S/o Shri Giridan @ Girwardan shall be released on sixth regular parole of forty days upon his furnishing a personal bond in the sum of Rs.50,000/- to the satisfaction of Superintendent, Central Jail, Udaipur. However, the other conditions of the order dated 14.10.2022 qua the convict petitioner are maintained.
The writ petition is disposed of accordingly.
