Learned counsel for the petitioner submits that as the previous criminal miscellaneous petition No.6095/2021 filed by the petitioner was dismissed as not pressed on 09.12.2021, the petitioner would be required to have recourse of suitable remedy in the said petition itself and this second petition may be permitted to be withdrawn with the above liberty.
Accordingly, the instant criminal miscellaneous petition as well as the stay petition are dismissed as withdrawn with the liberty prayed for.
