Instant petition has been filed by the petitioner with the following prayer:
“i. By an appropriate order or direction respondents no.1 to 5 may kindly be directed to fairly, impartially and speedy investigation in impugned FIR No. 362/2021 and take needful action for arresting accused persons.

ii. Any other order or directions which this Hon’ble Court deem just and proper looking to the facts and circumstances of the case may also kindly be passed in favour of the petitioner.”
Counsel for the petitioner submits that instant FIR was registered against the accused person but no sincere investigation has been done by the police. Hence, under these circumstances, the instant petition has been filed seeking directions for fair, impartial and speedy investigation.
In pursuance of the order dated 21.07.2022, learned Public Prosecutor has submitted the factual report which indicates that after investigation, police has submitted the Final Negative Report in this matter. Learned Public Prosecutor submits that under these circumstances, this petition has become infructuous.
At this stage, learned counsel for the petitioner wants to withdraw this petition and wants to file protest petition against the Final Negative Report submitted by the police.
The instant petition stands dismissed as withdrawn with the liberty aforesaid.
Stay application also stands dismissed.
The factual report submitted by the Investigating Officer is ordered to be taken on record.
