By way of the present petition under Section 482 of Criminal Procedure Code, 1973, the petitioner has challenged the F.I.R. No.95/2022, registered at Police Station Luni, District Jodhpur for the offences punishable under Sections 323, 341, 365/34 of the Indian Penal Code and Sections 3(1)(a) & 3(2)(va) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989, on the ground that the same has been lodged vindictively.

After arguing for some time, learned counsel for the petitioner, seeks permission to withdraw the present petition with a liberty to put forth his defence by way of representation along with documentary and other evidence before the Investigating Officer.

In case such representation is filed, the Investigating Officer shall consider the same, in accordance with law.

The present petition stands dismissed as withdrawn.
