The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.342/2021 Police Station Nohar, District Hanumangarh for the offence punishable under Section 8/22 of NDPS Act.

Learned counsel for the petitioner submits that according to the statement of the Investigating Officer-Ram Karan (PW1), there are major contradictions in the statement about the recovery of the strips as well as the total weight of the sample. The accusedpetitioner is in judicial custody and the trial of the case will take sufficient long time to be concluded. Therefore, the benefit of bail should be granted to the accused-petitioner.

Learned Public Prosecutor vehemently opposed the bail application filed by the petitioner.

I have considered the arguments advanced before me and gone through the material available on record.

The contraband, which was recovered from the possession of the present petitioner, is of commercial quantity, therefore, no case for grant of bail is made out. Hence, the present bail application filed by the petitioner is hereby dismissed.
