Learned counsel for the appellants submits that a specific allegation has been levelled against the accused Faizan Rangrej for inflicting knife injuries to the deceased – Gaurav Bhatt and omnibus allegations have been levelled against all the other coaccused persons. In this circumstances, the appellants may be granted bail.

Learned Public Prosecutor has opposed the appeals and prayer for bail.

I have considered the arguments advanced before me and gone through the material available on record.

A specific allegation has been levelled against all the accused persons that, all the accused persons gathered at a one place and

inflicted injuries to the deceased – Gaurav Bhatt and injured Hardik and Ajay and according to the postmortem report, the deceased had received three injuries and cause of death has also been opined as multiple injuries. The injured Hardik Bhatt S/o Bharat Kumar and Ajay S/o Ganeshlal have also received injuries.

In these circumstances, no case is made out for grant of bail and accordingly, all the four appeals are hereby rejected.

However, liberty is granted to the appellants to file fresh appeals after recording the statements of the injured persons, namely, Hardik and Ajay.

At the request of the learned counsel for the appellants, the Trial Court is directed to record the statements of the abovementioned injured persons, as early as possible.
