This bail application has been filed by the petitioners under Section 439 Cr.P.C. seeking regular bail in FIR No.115/2022 registered at Police Station Rajakhera, District Dholpur for the offence(s) under Section(s) 376-D & 457 IPC.

Learned counsel for the petitioners submits that the accused-petitioners are innocent and they have

falsely been implicated in this case. He has further submitted a copy of the statement of the prosecutrix as PW-1 and her husband as PW-2 wherein, the prosecutrix has not supported the prosecution story and has turned hostile and she has even specifically denied any offence committed by the accusedpetitioner. He also submits that the accusedpetitioners are in judicial custody since long and the conclusion of the trial will take long time, hence the petitioners may be enlarged on bail.

Learned Public Prosecutor appearing for the State as well as the learned counsel for the complainant have opposed the same.

Taking into consideration the overall facts and circumstances of the case, but without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail.

Therefore, this bail application is allowed and accused-petitioners 1.Gunda @ Harikishan S/o Shri Ramprakash & 2.Guppa @ Ramgopal S/o

Shri Rajveer are ordered to be released on bail provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioners shall
