This bail application has been filed under Section 439 of Cr.P.C. in connection with FIR No. 61/2022 registered at Police Station Newai, District Tonk for the offences under Sections 498-A & 304-B of IPC.

It is submitted by learned counsel for the petitioner that the petitioner is behind the bars since long and charge-sheet has been filed. The petitioner has no criminal antecedents. Both the parties have settled their dispute amicably. It is further submitted by learned counsel for the petitioner that he has filed an affidavit of the complainant, who is the brother of the deceased in the office, on 13.05.2022 and as per that affidavit, both the parties have settled their dispute amicably and removed their misunderstandings and the complainant doesn’t want further

action against the petitioner in this case. Hence, the accusedpetitioner may be released on bail.

Learned counsel for the complainant has no objection if the bail application of the petitioner is granted.

Learned Public Prosecutor has opposed the bail application. Heard and perused the material available on record.

The first bail application of the petitioner was dismissed by this Court vide order dated 11.04.2022. Both the parties have settled their dispute amicably and removed their misunderstandings.

Therefore, considering the submissions made by learned counsel for the petitioner as well as learned counsel for the complainant and looking to the overall facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail 2^nd application under Section 439 of Cr.P.C. is allowed and it is ordered that the accused-petitioner Ramavatar @ Rohit S/o Ramniwas shall be enlarged on bail; provided he furnishes a personal bond in the sum of Rs.50,000/with two sureties of Rs.25,000/- each (out of which one surety shall be resident of Tonk District) to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
