This is the second bail application under Section 439 Cr.P.C. The petitioner was arrested in connection with FIR No.236/2008, Police Station Soorsagar, Distt. Jodhpur for the offence under Sections 380, 120-B of IPC.

The first bail application of the petitioner was dismissed by this court vide order dt. 30.03.2022 with direction to the trial court to conclude the trial as far as possible preferably within a period of three months.

Learned counsel for the petitioner submits that co-accused Ugam Singh has already been granted bail by coordinate Bench of this Court on 01.04.2022 and the case of the present petitioner is on the same footing. It is further submitted that some of the coaccused are still absconding and the trial of the case is not being

progressed. In these circumstances, the petitioner may be released on bail.

Learned Public Prosecutor has opposed the prayer made by the petitioner.

I have considered the arguments advanced before me and perused the material available on record.

The first bail application of the petitioner has been dismissed by this Court vide order dt. 30.03.022, in which, a specific direction has been made to the effect that the trial court shall conclude the trial as early as possible preferably within three months. Looking to the facts and circumstances of the case since there is no change in the circumstances, this second bail application is dismissed.

However, considering the fact that some of the accused are still absconding, the trial court is directed to proceed qua the present petitioner separately and conclude the trial of the petitioner as directed by this Court vide order dt. 30.03.2022.
