1. The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner Sonu S/o Ram Lal. The petitioner has been arrested in connection with FIR No. 15/2022 registered at Police Station Deoli Manjhi, District Kota for the offence(s) under Sections 363, 376 (2) (i) of IPC and Section 3/4 of protection of Children from Sexual Offences Act.

Learned counsel for the petitioner drew attention of this court towards the statement of the prosecutrix-M, recorded under Section 164 Cr.P.C. wherein she has not levelled any allegations against the petitioner, rather an exculpatory statement has been made. I do not feel persuaded to allow further incarceration of the accused.

4- Considering the arguments advanced by counsel for the

parties and looking to overall facts and circumstances of the case and without going into the niceties of the matter this court deems it just and proper to enlarge the petitioner on bail.

5- Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner named above shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/with two sureties of ~s.25,000/- each to the satisfaction of the learned trial judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
