Learned counsel for the petitioner does not want to press the present bail application but seeks liberty for the petitioner to file a fresh bail application after recording of the statements of Khuma Gameti and Bhanwar Gameti.
Accordingly, the present bail application moved under Section 439 Cr.P.C. on behalf of the accused-petitioner - Chunni Lal S/o Lt. Deva, stands dismissed as not pressed with liberty as prayed for.
Looking to the period of custody of the accused-petitioner, learned trial Court is directed to record the statements of abovementioned witnesses as early as possible on priority basis.
