Heard learned counsel for the petitioner and learned Public Prosecutor.
Learned counsel for the petitioner stated that at the time of rejection of first bail application, a liberty was grated to file fresh bail application after recording of the statement of material witnesses. Thereafter, statement of fifteen witnesses have been recorded before learned trial Court.
At this juncture, learned counsel for the petitioner does not want to press this bail application at this stage with liberty to file fresh bail application after recording statement of Dhuliya s/o Tejiya and Vikla s/o Jotee.
The second bail application is dismissed as not pressed with the liberty aforesaid.

However, looking to the facts and circumstances of the case, learned trial Court is directed to record the statment of abovementioned witnesses on priority basis.
