The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No.178/2021 at Police Station Bidasar, District Churu registered for the offences punishable under Sections 341, 323, 365, 382, 458, 506 and 143 of IPC.

Heard learned counsel appearing for the petitioner as well as learned Public Prosecutor. Perused the material available on record.

Learned counsel appearing for the petitioner stated that offence is triable by the Magistrate; FIR was filed after a delay of 9 months and there is no explanation of the said delay; benefit of bail has already been granted to the co-accused Mahendra; trial will take time. With these submissions, learned counsel for the petitioner prayed that benefit of bail may be granted to the petitioner.

Per contra, learned Public Prosecutor opposed the bail application and stated that earlier, 2 other cases have been registered against the accused-petitioner.

Having regard to the facts and circumstances of this case, without expressing any opinion on the merits/demerits of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted.

Consequently, the present bail application is allowed. It is ordered that the accused-petitioner – Kishan Prajapat S/o Chhagan Lal Prajapat, arrested in connection with F.I.R. No.178/2021 at Police Station Bidasar, District Churu shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of 50,000/- (Rupees Fifty Thousand)₹ and two sureties of 25,000/- (Rupees Twenty Five Thousand)₹ each to the satisfaction of the learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
