These bail applications have been filed under Section 439 Cr.P.C in connection with FIR No.276/2021 registered at Police Station Hindoli, District Bundi for the offences under Sections 147, 149, 323, 307, 120-B & 34 of IPC and under Section 3/25 of Arms Act.

Learned counsel for the petitioners submits that the petitioners are not named in the FIR. The petitioners Aman Mriza @ Aman Mitha and Gurpreet @ Gopi are behind the bars since 31.01.2022 & 07.12.2021 respectively. Counsel further submits that charge-sheet has been filed against the petitioners for the offences under Sections 147, 149, 323, 307 & 120-B of IPC and not under Section 3/25 of the Arms Act. Counsel also submits that as per rejection bail order, the petitioner Aman Mriza @ Aman Mitha has criminal antecedents of seven cases, in which, he is on bail and the petitioner Gurpreet @ Gopi has criminal antecedents of three cases, out of which, one case has been disposed of and in remaining two cases, he is on bail. Hence, the petitioners may kindly be released on bail.

Learned Public Prosecutor has opposed the bail applications.

Considering the submissions made by learned counsel for the petitioners and taking into consideration overall facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the petitioners on bail.

Accordingly, the bail applications under Section 439 Cr.P.C. are allowed and it is ordered that the petitioners Aman Mriza @ Aman Mitha S/o Resama Mriza and Gurpreet @ Gopi S/o Jarnel Singh shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each (out of which one surety shall be the resident of Bundi District for the petitioner Aman Mriza @ Aman Mitha S/o Resama Mriza) to the satisfaction of the learned trial
