This bail application has been filed under Section 439 Cr.P.C in connection with FIR No.0165/2018 registered at Police Station Mansalpur, District Karauli for the offences under Sections 143, 384, 379, 323, 341, 395, 397 & 504 of IPC and under Section 11 of Rajasthan Dacoity Affected Area Act, 1986.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR and the injuries received by the injured are simple in nature. The petitioner is behind the bars since 31.01.2019 and charge-sheet has already been filed. Counsel further submits that Session case is pending before learned trial Court at the stage of recording of statement of the petitioner under Section 313 of Cr.P.C. and summoning of coaccused for recording of the statement. Counsel submits that the bail application of co-accused Vachan Singh has already been

granted by the co-ordinate Bench of this Court vide order dated 03.12.2019. The petitioner has criminal antecedents of ten cases and he is on bail in all the pending cases. Hence, the petitioner may kindly be released on bail.

Learned Public Prosecutor has opposed the bail application.

Considering the submissions made by learned counsel for the petitioner and taking into consideration overall facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the petitioner Shriniwas S/o Ramswaroop Gurjar shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each (out of which one surety shall be the resident of Karauli District) to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
