These bail applications under Section 439 Cr.P.C. have been filed by the petitioners in connection with FIR No. 546/2022, registered at Police Station Dudu, District Jaipur Rural wherein they are charged for offences punishable under Section 143, 283, 332, 333 and 353 of IPC and under Section 8 (B) of National Highway Act, 1956.

Learned counsel for the petitioners submits that the general omnibus allegations have been levelled against the petitioners and no specific act has been assigned to them. The petitioners are in judicial custody since the date of their arrest and the alleged offences are triable by the Magistrate. Counsel further submits that the conclusion of the trial will take its own time, so indulgence of bail may be granted to them.

Per contra, learned Public Prosecutor has opposed the bail application.

Considering the arguments put forward by the learned counsel for the petitioners and looking to the fact that the alleged offences are triable by the Magistrate, trial will take its own time to conclude and no overact has been assigned to the petitioners but without expressing any opinion on merits and demerits of the case, I deem it just and appropriate to grant indulgence of bail to the petitioners under Section 439 Cr.P.C.

Accordingly, the bail applications under Section 439 Cr.P.C. are allowed and it is ordered that accused-petitioners namely Sohel

S/o Shahbuddin and Mohammad Haneef S/o Mohammad

Saleem arrested in connection with the aforementioned FIR, may be released on bail; provided each of them furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
