The present bail application under Section 439 Cr.P.C. has been filed on behalf of petitioners in connection with FIR No.501/2022 registered at Police Station Kotwali, District Dausa wherein he is charged for the offence punishable under Sections 457 and 380 IPC.

Counsel for the petitioners submits that there is no recovery at the instance of the petitioners and the alleged offences are triable by Magistrate. Counsel submits that the petitioners are

ladies and therefore, he prayed that indulgence of bail may be granted to the petitioners in view of proviso attached to Section 437 Cr.P.C.

Per contra, learned PP has opposed the bail application.

Considering the arguments put forward by counsel for the petitioners and looking to the fact that the alleged offences are triable by Magistrate and trial will take its own time to conclude, looking to the proviso attached to Section 437 Cr.P.C., without expressing any opinion on merits and demerits of the case, this Court deems it just and proper to enlarge accused-petitioners on bail under Section 439 Cr.P.C.

Accordingly, this bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioners (1) Anita Devi @ Kakdi W/o Vijay @ Janak (2) Sona @ Kali @ Kolan W/o Dinesh @ Terya and (3) Smt. Santra @ Rajanti @ Langdi W/o Mohan shall be released on bail, provided each of them executes a personal bond in the sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
