This bail application under Section 439 Cr.P.C. has been filed by petitioner in connection with FIR No.32/2013, registered at Police Station Mandawar, District Dausa wherein he is charged for offences punishable under Sections 363 & 376/511 of IPC, under Section 11 (ii)/12 of POCSO Act and under Section 3 (i) (ii) of SC/ST Act.

Learned counsel for the petitioner submits that due to the circumstances beyond the control of the petitioner, he could not appear before the court below on the date fixed and his bail bonds were forfeited on 07.07.2022. Counsel further submits that the petitioner has been arrested on 17.08.2022 and he is in judicial custody since then. Counsel also submits that the petitioner undertakes that he will not misuse the liberty again, so indulgence of bail be extended to the petitioner.

Per contra, learned Public Prosecutor opposed the bail application.

Looking to the fact that the bail bonds of the petitioner were forfeited on 07.07.2022, he was arrested on 07.08.2022 and trial will take its own time to conclude, I deem it just and appropriate to grant indulgence of bail to the petitioner under Section 439 Cr.P.C.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner Rajesh Kumar S/o Kishan Lal arrested in connection with aforementioned FIR, may be released on bail; provided he furnishes a personal bond of Rs.1,000,00/- with two surety bonds of Rs.50,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
