This bail application under Section 439 Cr.P.C. has been filed by petitioner in connection with FIR No.87/2022 registered at Police Station Bagad, District Jhunjhunu wherein he is charged for offences punishable under Sections 376, 384 & 506 of I.P.C.

Learned counsel for the petitioner submits that the prosecutrix is a major lady aged of 24 years. Counsel submits that for the incidents occurred in the year 2020-21, a delayed and unexplained report has been lodged. Counsel submits that there was money transaction dispute between the petitioner and the prosecutrix. Counsel submits that the petitioner is in custody since 05.06.2022. After investigation, charge sheet has been submitted and the trial will take its own time to conclude.

Per contra, learned Public Prosecutor as well as learned counsel for the complainant have opposed the bail application.

Heard and considered the submission made by the parties and

perused the statements of the prosecutrix recorded under Section 164 of Cr.P.C. Looking to the nature of allegations levelled in the statements recorded under Section 164 of Cr.P.C. and looking to the long delay in lodging of the FIR, without expressing any opinion on merits or demerits of the case, I deem it just and appropriate to grant indulgence of bail to the petitioner under Section 439 Cr.P.C.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner- Jalam Bharti S/o Bhagwan Bharti arrested in connection with FIR No.87/2022 Police Station Bagad, District Jhunjhunu may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
