Apprehending his arrest in connection with FIR No. 333/2021 registered at Police Station Kotwali Dausa, District Dausa for the offence(s) under Sections 8/21 of the NPDS Act, the petitioner has preferred this anticipatory bail application under Section 438 Cr.P.C.
Learned counsel for the petitioner submits that the recovery of a contraband ‘Smack’ weighing 10.02 grams + 8 grams, is affected from the co-accused Rizwan and Asif. The petitioner has nothing to do with the alleged offences. He has falsely been implicated in this case.
Heard learned counsel for the parties and perused the entire material made available on record. It is reflecting that during the course of the investigation, it came to record that the accusedpetitioner was also present there but after seeing the police, he succeeded in making his escape good. collected by the Agency to implicate him as an accused. In this view of the matter, this Court is not inclined to allow the instant anticipatory bail application filed on behalf of the present accusedpetitioner.
Accordingly, the instant anticipatory bail application is dismissed.
