The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner-Bansi Tomar Son Of Ramesh Tomar against the order dated 24.05.2022 passed by learned Court below for the offence under Section 3 of R.P.U.P Act in FIR No.12/2016 registered at Police Station R.P.F Gangapur City, District Sawai Madhopur.

Learned counsel for the accused-petitioner submits that a false case has been foisted against the petitioner. The accusedpetitioner has nothing to do with the alleged offences. He further submits that the petitioner is a very poor person. He along with his family members went to other State to earn livelihood and forgot the pendency of the case. He is behind the bars. His further incarceration would not serve any useful purpose. Learned counsel

assures that on future dates of trial, he shall make himself available either personally or through pleader and will not impede the course of trial.

Per contra, learned Public Prosecutor opposed the bail application.

Considering the arguments advanced by the counsel for the parties and looking to the possibility that the trial may take long time to conclude, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner, named above, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
