This anticipatory bail application has been filed under Section 438 of Cr.P.C. in connection with FIR No. 256/2020 registered at Police Station Kishangarh, District Ajmer for the offences under Sections 420, 406, 467, 468, 471 and 120-B of IPC.

Learned counsel for the petitioners submits that the petitioners have signed the alleged deed in presence of Mahesh Chand Rathi (father of the complainant) and Harmeet Singh but after enquiring it has been found that the signature does not match. Learned counsel further submits that the petitioners have no criminal antecedents and son of the petitioner No.1-Sunil has

also lodged an another FIR No.82/2021. Learned counsel further submits that the petitioner No.1-Suresh Chand Enani is 55 years of age and the petitioner No.2 is a woman of 30 years of age and they have given interim protection from arrest by the Co-ordinate Bench of this Court vide its order dated 28.07.2022, which is still in force till today. Learned counsel also submits that anticipatory bail applications of the co-accused Mahesh Chand Rathi & Harmeet Singh have also been allowed by the Co-ordinate Bench of this Court vide its order dated 18.04.2022. Hence, the anticipatory bail application of the accused-petitioners may kindly be granted.

On the other hand, learned Government Advocate has opposed the bail application.

Heard learned counsel and perused the material available on record.

¶20

Considering the submissions made by the learned counsel for the petitioners and looking to the facts and circumstances of the case but; without expressing any opinion on the merits and demerits of the case, I deem it just and proper to enlarge the petitioners on anticipatory bail.

Accordingly, this anticipatory bail application is allowed and it is ordered that in case of arrest of the accused-petitioners in FIR No. 256/2020 registered at Police Station Kishangarh, District Ajmer by the Investigating Officer, the accused-petitioners shall be released on bail; provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs. 25,000/- each to the satisfaction of concerned SHO/IO on the following conditions:

i) That the petitioners will make themselves available for the investigation as and when required by the investigation officer.

ii) That the petitioners will not leave India without permission of the Court.

¶26

iii) That the petitioners will not tamper with the evidence or threaten or pressurize the witnesses in the case.
