The instant appeal has been filed under Section 14A (2) Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act on behalf of the appellant, who is in custody in connection with FIR No.17/2022, Police Station Nokha, Distt. Bikaner for the offences under Sections 450, 506, 376(2)(N), 376D, 342, 382 of the IPC and Section 3(2)(v) & 3(2)(V A) of SC/ST (Prevention of Atrocities) Act, against the order dated 16.03.2022 passed by the learned Special Judge SC/ST (Prevention of Atrocities) Cases & Additional Sessions Judge, Bikaner in Criminal Misc. Bail Application (CIS) No.527/2022 whereby, the bail application of the appellant was rejected.

Learned counsel for the appellant submits that the appellant and the prosecutrix, both got married and thereafter, they submitted an application before the concerned SP seeking protection and protection was granted to them. When the prosecutrix was taken to her parental house, a false FIR has been lodged against him. In these circumstances, the appellant may be released on bail.

Learned Public Prosecutor and learned counsel for the complainant vehemently opposed the prayer made by the appellant.

I have considered the arguments advanced before me and perused the material available on record.

According to the statements of the prosecutrix under Section Sections 161 & 164 Cr.P.C., a specific allegation has been levelled against the appellant as well as three more accused.

No case for grant of bail is made out.

Accordingly, the criminal appeal/bail preferred by the appellant is hereby rejected.
