The instant appeal has been filed under Section 14A (2) of SC/ST (Prevention of Atrocities) Act on behalf of the appellant, who is in custody in connection with FIR No.310/2021, Police Station Mahaveer Ji, District Karauli for the offences under Sections 143, 323, 341, 325, 308, 34 & 504 of IPC and Sections 3(1)(r)(s) & 3(2)(VA) of the SC/ST (Prevention of Atrocities Act) against the order dated 02.02.2022 passed by the Special Judge, SC/ST (Prevention of Atrocities) Cases, Karauli, whereby, the bail application preferred under Section 439 Cr.P.C. on behalf of the appellant was rejected.

Learned counsel for the appellant submits that the appellant is behind the bars since 30.01.2022 and he has no criminal antecedents. Hence, the appellant may kindly be released on bail.

Learned Public Prosecutor has opposed the appeal and submitted that despite service, none has appeared on behalf of the complainant/respondent No.2.

Heard. Perused the material available on the record.

As per injury and X-Ray reports of Manoj, all injuries are simple in nature and as per injury and X-Ray reports of Mahendra @ Plane, except injury Nos.3, 4 and 5, all injuries are simple in nature. Injury Nos. 3 and 4, which are grievous in nature, caused by blunt weapon are on his right-forearm and left leg respectively and injury No.5, which is also grievous in nature, caused by a weapon (can’t) is on his left-forearm above elbow. Therefore, looking to the above facts and circumstances of the case but without expressing any opinion on the merits and demerits of the case, this Court is of the opinion that the appellant deserves to be enlarged on bail.

Consequently, the instant appeal is allowed. The impugned order dated 02.02.2022 passed by the Special Judge, SC/ST (Prevention of Atrocities) Act Cases, Karauli is set aside and it is ordered that the accused-appellant Dharmendra Singh @ Dhammu Son Of Shri Datar Singh arrested in connection with aforesaid F.I.R. shall be released on bail; provided he furnishes a personal bond of Rs. 50,000/- with two sureties of Rs. 25,000/each to the satisfaction of the learned trial Court with the
