These instant appeals have been filed under Section 14A/14A(2) SC/ST (Prevention of Atrocities) Act on behalf of the appellants, who are in custody in connection with FIR No.396/2021, Police Station Khetri, District Jhunjhunu for the offences under Sections 143, 341, 323, 365, 307 & 327 of IPC, under Sections 3/27 Arms Act and under Sections 3(2)(va) & 3(2) (v) of the SC/ST (Prevention of Atrocities) Act.

Heard learned counsel for the appellants and learned Public Prosecuton. Perused the material available on record.

It is submitted by learned counsel for the appellants that the bail pleas of co-accused persons Subhash Chandra & Sandeep have already been allowed by this Court and the case of the present appellants is not distinguishable than that of the accused in any manner, therefore, benefit of bail may be granted to the appellants.

Per contra, learned Public Prosecutor opposed the bail plea.

Having regard to the totality of facts and circumstances as available on record and upon a consideration of the arguments advanced, I am of the opinion that the appellants deserve to be enlarged on bail.

Consequently, these instant appeals are allowed. The impugned orders dated 19.05.2022 & 23.03.2022 passed by the Special Judge, SC/ST (Prevention of Atrocities) Cases, Jhunjhunu are set aside. It is ordered that the accused-appellants -Lokesh @ Lakki Son Of Sultanram, Ravikumar @ Ravi Singh Son Of Dharmpal Singh & Sajjan Kumar S/o Jayram arrested in connection with aforesaid FIR , shall be released on bail, if not wanted in any other case, provided them furnishes a personal bond of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and when called upon to do so.
