The appeal was originally filed on behalf of two appellants. One of the appellants Malkiyat Singh passed away wayback on 28.03.1990 and the appeal to the extent was abated on 24.04.2000. The bailable warrant issued against the appellant Gura @ Gurcharan Singh has been received with a report that he too passed away on 13.10.2010. Copy of the death certificate issued by the Municipality, Kesrisinghpur is annexed with the report.

In view of the fact that the sole surviving appellant Shri Gura @ Gurcharan Singh has passed away, the appeal abates and is disposed of as such. The record be returned to the trial court.
