Petitioners have filed this contempt petition alleging therein that the order dated 06.10.2016 passed by the Co-ordinate Bench of this Court in S.B. Civil Writ Petition No.1452/2003 titled as Mohan Singh & Others Vs. State of Rajasthan & Others, has not been complied with.

Heard learned counsel appearing for the parties and perused the material made available on record.

On 06.10.2016 Co-ordinate Bench of this Court, had passed

the following order :-

“Learned counsel submits that Coordinate Bench has passed following order in bunch of writ petitions led by S.B.Civil Writ Petition No.9876/2010 in the case of Central Government Employees vs. State of Rajasthan and Anr. decided on 29.09.2015. Thus present writ petition may also be ordered to be governed by the direction of aforesaid.

For convenience, the order of the Coordinate Bench is quoted hereunder:-

“Counsel for the petitioners submit that petitions be disposed of as was similar writ petition No.4370/2012 vide order dated 23- 9-2013 as clarified vide order dated 18-11-2013 with liberty to the petitioners to make representation/s to the respondents with regard to their grievances including the issue of non payment of due honorarium @ Rs.50/- per month and regularization.

Taking into consideration the submissions of counsel for the petitioners and having perused the order dated 23-9-2013 in SBCWP No.4370/2012 as clarified on 18-11-2013, these petitions are disposed of as prayed. The petitioners shall be at liberty to move representation/s before the competent authority ventilating their grievances, as advised, including that pertaining to alleged non payment of due honorarium due. In the event of representation being made within a period of fifteen days, the competent authority shall consider and decide the same by a reasoned and speaking order within two months from the date of receipt of the said representation/s.

The petitions stand disposed of accordingly.

A copy of the order be placed in each file.”

In view of the above, this writ petition is ordered to be governed by the order quoted above.

With the aforesaid writ petition stands disposed of.“

Ajmer (Chairman of Committee) has already considered and decided the representation submitted by the petitioners vide order dated 08.04.2018 in the light of directions issued by the Co-ordinate Bench of this Court. It is further submitted that the order dated 06.10..2016 passed by the Co-ordinate Bench of this Court has been fully complied with by the respondents and the delay caused in complying with the aforesaid order was bona-fide & procedural and has been sufficiently explained in the compliance report.

In view of the reply submitted by the respondents, no ground for further interference is made out.

Petition stands disposed of accordingly. Rule is discharged.
