This Civil Misc. Application under Article 226 of the Constitution of India has been preferred on behalf of the petitioner-applicant for recalling of the order dated 12.7.2021 passed in SBCWP No.322/2021.

It is submitted that the respondent No.2 has moved an application (01/21) in SBCWP No.322/2021 under Article 226 of

the Constitution of India for dismissal of the aforesaid writ petition as being not maintainable on the ground of territorial jurisdiction.

On 12.7.2021, learned counsel for the respondent No.2 has made a prayer before this Court that he may be permitted to withdraw the application (01/21) moved in SBCWP No.322/2021, however, due to inadvertence, instead of the aforesaid application (01/21), the writ petition SBCWP No.322/2021 itself has been dismissed as withdrawn on the ground of non maintainability.

Learned counsel for the petitioner-applicant, thus, prayed that while allowing this Civil Misc. Application, the order dated 12.7.2021 passed in SBCWP No.322/2021 may be recalled; the aforesaid writ petition may kindly be ordered to be restored to its original number and the application (01/21) moved in the abovereferred writ petition may be ordered to be dismissed as withdrawn.

In view of the above, this Civil Misc. Application is allowed. The order dated 12.7.2021 passed in SBCWP No.322/2021 is hereby recalled; the aforesaid writ petition is restored to its original number and the application (01/21) moved in the abovereferred writ petition is dismissed as withdrawn.
