Learned counsel appearing for the appellant submits that the controversy raised in this special appeal stands set at rest by a Bench decision of this Court dated 17.08.2021 rendered in D.B. Special Appeal (W) No.483/2021 : Abhay Pratap Vs. State of Rajasthan & Ors., therefore, in the light of said decision, the present special appeal also deserves to be dismissed.
Accordingly, the present special appeal is dismissed in the light of decision of this Court in the case of Ahbay Pratap ( supra ).
