The present Special Appeal has been filed against the order dated 01.02.2021 passed by the learned Single Judge in S.B. Civil Writ Petition No.12832/2020, vide which the petition has been dismissed.

An application (I.A. No.1/2021) under Order 41 Rule 27 CPC has been filed on behalf of the appellant for taking some documents on record.

Since the documents intended to be filed under Order 41 Rule 27 CPC were not available before the learned Single Judge at the time of disposal of the petition, therefore, the impugned order dated 01.02.2021 is quashed and set aside and the matter is remanded back to the learned Single Judge with the request to hear and dispose of the petition afresh after taking into consideration the documents filed by the appellant under Order 41 Rule 27 CPC, in accordance with law.

The appeal is accordingly disposed of. All pending applications also stand disposed of.
