In wake of second surge in the COVID-19 cases, abundant caution is being maintained, while hearing the matters in Court, for the safety of all concerned.

The petitioner preferred the present writ petition claiming the following relief:-

"It is, therefore, most respectfully prayed that this 2nd Stay Petition may kindly be allowed and the respondent No.2 may kindly be directed to leave the possession from the property in dispute, in the alternate, the respondent Bank may kindly be directed to bear all the costs of handing over the secured assets of the petitioner, in terms of order dated 19.09.2018 passed by Hon'ble Court. "

Learned counsel for the petitioner and counsel for the respondent-Bank fairly submitted that the complete amount with respect to the dues of loan has been settled between the parties.

Learned counsel for both the parties also informed the Court that the amount taken from the respondent No.2, as a bidder to the extent of 25% has already been returned.

In light of the aforesaid submissions, nothing survives in the present writ petition for any adjudication, as the matter has been settled between the respondent-Bank and petitioner.

Thus, the petition is disposed of with a direction to the Bank to handover the possession to the petitioner strictly in accordance with law as soon as possible.

All pending applications also stand disposed of accordingly.
