In S.B. Civil Writ Petition No. 2826/2013, 6258/2016, 7972/2016, 7976/2016, 7977/2016, 16181/2017, 16899/2017, 526/2018, 528/2018, 590/2018, 628/2018, 1735/2018, 3024/2016, 3025/2016, 8824/2013, 3848/2016, 8804/2013, 6286/2013, 4156/2013, 6287/2013 & 10936/2013:-

The matter pertains to the Industrial Plots to be allotted by the respondents in accordance with law.

At the outset, learned counsel for the respondent Mr. Sanjeet Purohit submits that in all the aforesaid writ petitions, the conclusive order has been passed by the Committee headed by the Divisional Commissioner on dated 13.05.2017 deciding the claim of allotment of industrial plots.

Learned counsel for the respondents submits that in case, any of the petitioner is adversely affected by the order of the Committee dated 13.05.2017, then it would be appropriate to permit them to take their separate remedies. It is further contended that without challenging the rejection order dated 13.05.2017, their right cannot be adjudicated.

Learned counsel for the petitioners submits that they have good case on merits but however, they are unable to refute the fact that the order of the Committee dated 13.05.2017 is not under challenge.

Learned counsel for petitioners also submits that they would have definitely challenged it, but it was not conveyed properly to the present petitioners and thus, the delay in taking appropriate remedy may be condoned and a fresh opportunity be given.

In light of the aforesaid submissions, the present petitions are disposed of with liberty to the petitioners to take up their individual cases by challenging the order dated 13.05.2017, if so advised.

At the outset, Mr. Sanjeet Purohit learned counsel for the RIICO submits that the industrial plots have already been allotted to the present petitioners vide order dated 13.05.2017, and the said decision was taken by the Committee headed by the Divisional Commissioner.

In light of such submission made by learned counsel for the respondent-RIICO, the present petitions are disposed of as having become infructuous.

However, in case, any cause of action still survives, it shall be open for the petitioners to take all their appropriate recourse available in law.
