Learned counsel for the petitioner, submits that the issue involved in the present case is squarely covered by the judgment dated 23.10.2021 passed by this Court in the bunch of writ petitions led by Surender Kaur Memorial College of Higher Education Vs. State of Rajasthan & Ors : SB Civil Writ Petition No.2359/2021 .

Mr. Pankaj Sharma, learned AAG for the respondent – State, is not in a position to dispute the aforesaid position of facts and law.

In the case of Surender Kaur (supra), this Court has observed thus :

“40. The affiliating authority, namely, State of Rajasthan or the respondent – University (as the case may be) are hereby directed to carry out the exercise of granting staff approval. The requisite exercise be done latest by 20.11.2021, obviously after being satisfied about the norms set by the NCTE/competent authority in this regard. Acceptance or rejection be intimated to all concerned.

41. Till the state government takes a conscious decision in relation to staff approval and intimates all concerned, the NCTE shall not reject petitioners’ pending applications for recognition.”

The writ petition is disposed of in terms of the aforesaid judgment passed in the case of Surender Kaur (supra).

Stay application also stands disposed of accordingly.
