Counsel for the petitioners submitted that the issue involved in these writ petitions have already been considered by a Coordinate Bench of this Court, at Principal Seat, Jodhpur in the matter of Renu Kumari Khoiwal Vs. State of Rajasthan & Ors. (S.B. Civil Writ Petition No.14477/2019), wherein on 27.09.2019 the following order was passed:-

“It is submitted by learned counsel fro the petitioner that the petitioner has been called for PST/PT on 23.09.2019 for the post of SubInspector vide Annex.-3, however, the petitioner due to pregnancy is not in a physical condition to undergo PST/PET.

In view of the submissions made, issue notice. Issue notice of the stay application also, returnable in four weeks. Notices when issued by given “Dasti” to the learned counsel fro the petitioner. In the meanwhile and until further orders, the respondents shall not cancel the candidature of the petitioner for not undergoing PST/PT

pursuant to the admission card issued to her for the post of Sub-Inspector.

Counsel further submitted that all the petitioners have participated in the PST/PET conducted by the respondents, in view of the interim orders either passed by this Court or by orders of the State Government.

Counsel further submits that the issue involved in these writ petitions have already been decided by a Co-ordinate Bench of this Court, at Principal Seat, Jodhpur in the matter of Renu Kumari Vs. State of Rajasthan (S.B. Civil Writ Petition No.14477/2019) decided on 10.09.2020, which reads as under:-

“In wake of onslaught of COVID-19, abundant caution is being taken while hearing the matters in Court.

¶136

Learned counsel for the respondent submits that the relief claimed in the petition has been granted.

¶137

Learned counsel for the petitioner is not in a position to refute the submission made by learned counsel fro the respondent. In light of such submission, the present petition is dismissed as having become infructuous. It is needless to say that the result of the petitioner, for the procedure already undergone, shall be declared expeditiously by the respondent. All pending applications stand disposed of accordingly.”

Counsel further prayed that the respondents be directed to declare the result of the petitioners, if found suitable and comes in merit, the appointment be given to them for the post of SubInspector.

Counsel appearing on behalf of the respondent-RPSC has not disputed the judgment passed by this Court in the matter of Renu Kumari (supra).

Since, all the petitioners have participated in the PST/PET, in

compliance of the order either passed by this Court or by the State Government, I dispose of these writ petitions with the direction to the respondent-RPSC to declare the result of all the petitioners expeditiously.
