The petitioners have challenged the policy of the State Government in not applying the relaxed standards for passing the REET test for outstanding sports persons. Both the petitioners belong to the outstanding sports persons category. The State of

Rajasthan has provided reservation in public employment to the extent of 2 percent in favour of such class. However, in order to secure the appointment as a school teacher, such candidates like others, would also had to appear in the REET test and pass as per the prescribed standards. The petitioners would point out that by an order dated 16.12.2020, the State Government has prescribed the minimum standard for passing the REET as 60 marks which will be relaxed to 55 marks for SC/ST and OBC, MBC, EWS category candidates, 50 marks for widow, divorced candidates and Ex-serviceman, 40 marks for physically handicapped candidates, and 36 marks for a community called ‘ Sahariya ’.
The grievance of the petitioners is that no matching relaxation has been provided for reserved category of outstanding sports persons.
In our opinion, the decision is one of the policy matters. The State Government having provided reservation for a particular category, whether look into special requirements and challenges faced by persons of such category in relaxation standards should be applied or not, must be a matter to be decided by the Government.
In the result, we do not find any merit in the petition. The same is dismissed accordingly.
