By order dated 01.10.2021, it was directed as under:-
“In the circumstances of the case, in case, the petitioner produces himself for cross-examination and produces all his evidence on the date to be fixed by the Labour Court on 04.10.2021, which date would be before 29.10.2021 and makes payment of cost of Rs.5,000/- to the representative of the respondent, the petitioner would be permitted to be crossexamined and his witness be also examined.
In case, the petitioner fails to produce himself on the date to be fixed by the Labour Court for crossexamination / fails to produce his witness also on the said date / fails to pay the cost to the representative of the respondent-Company, no further opportunity shall be granted.
In case, the cost is not accepted by the representative of the respondent-Company and respondent wants to contest the present writ petition, further proceedings before the Labour Court, Jodhpur in Labour Case No.110/2009 shall remain stayed.”
Learned counsel for the petitioner submits that pursuant to
the order dated 01.10.2021, the petitioner has paid the cost to

the respondent, which has been accepted and that though the petitioner and/or his witness were present, on account of certain proceedings, have not been examined.
In that view of the matter, the order dated 01.10.2021 is made absolute, the petition filed by the petitioner stands disposed of.
