By way of present writ petition, the petitioners are seeking directions to the respondents not to reduce the quantity of drinking water as demanded by the Superintending Engineer, Public Health and Engineering Department, Pali vide communication dated 05.10.2020 for villages of Pali, Sirohi and Jalore districts.

It is noticed that the matter with regard to allocation of water available in Jawai Dam for drinking and irrigation purposes was considered by the Jawai Dam Water Distribution Committee presided over by the Divisional Commissioner, Jodhpur in its meeting held on 07.10.2020. The Committee noticed that as against 2566.45 Million Cubic Feet (MCF) water reserved for drinking purposes in the previous year, the PHED utilized 2363 MCF water. Accordingly, taking into consideration the total quantity of the water available in Jawai Dam and Hemawas Dam as against the water reserved in previous year i.e. 2566.45 MCF, 2899.65 MCF water has been reserved for drinking water requirement of 10 urban areas and 787 villages of Pali District and town Sheoganj of Sirohi District.

This Court has no expertise to look into the matter with regard to distribution of the water available for irrigation and drinking purposes. A

perusal of the minutes reveals that after due consideration of the demand raised by the PHED, the Committee has determined the quantity of the water to be reserved for irrigation and drinking purposes, which cannot be interfered with by this Court in PIL jurisdiction. If the petitioners have any grievance with regard to the proportion of the distribution of the water made for irrigation and drinking purposes, it is always open for them to approach the State Government.

No case for interference by this Court in exercise of writ jurisdiction is made out.

The writ petition is therefore, dismissed.
