The present transfer application under Section 24 of Code of Civil Procedure has been filed by the petitioner-wife who got married with the respondent on 02.10.2014. The petitioner has prayed to transfer the Case No.3689/2019 titled as Nitesh Choudhary Vs. Smt. Soniya Choudhary from Family Court No.1, Jaipur to Family Court, Ajmer.

Learned counsel for the petitioner submits that petitioner is a lady and her financial condition is not good. She has a male child of 5 years. She had filed criminal case under Section 498A, 406 and another case under Section 12 of Domestic Violence Act which were pending at Jaipur. Petitioner cannot attend the proceeding pending before learned Family Court No.1, Jaipur. So, case

Learned counsel for the respondent opposed the arguments advanced by learned counsel for the petitioner and prayed to dismiss the petition filed by the petitioner.

I have considered the arguments advanced by learned counsel for the petitioner as well as learned counsel for the respondent. Petitioner being a lady, will certainly face hardship and inconvenience in attending the case pending before learned Family Court No.1, Jaipur. So, application filed by the petitioner is bona fide and reasonable.

Application filed by the petitioner is allowed and proceeding pending before learned Family Court No.1, Jaipur in Case No.3689/2019 titled as Nitesh Choudhary Vs. Smt. Soniya Choudhary, is transferred to learned Family Court, Ajmer.

Parties are directed to appear before learned Family Court, Ajmer on 28.07.2021.
