Petitioner-Juned Alam has filed second bail application and petitioner- Mohd. Jaheer Alam has filed third bail application under Section 439 of Cr.P.C.

F.I.R. No.245/2018 was registered at Police Station GRP, Kota for offence under Sections 328 or in alternate offence under Section 328/34 and 380 of I.P.C.

It is contended by counsel for the petitioners that co-accused

Md. Safar has been given benefit of bail by the Co-ordinate Bench. It is contended that out of thirteen witnesses, only ten witnesses have been examined. Witnesses are not turning up due to Covid.

Learned Public Prosecutor has opposed these bail applications. It is contended that petitioners are involved in administering poisonous drugs and looting passengers. It is also contended that petitioners have been identified by the complainant and petitioners have three criminal antecedents of like nature.

For this, counsel for the petitioner states that co-accused Md. Safar also has three criminal antecedents of like nature. 6. I have considered the contentions. 7. This Court has rejected the first bail application of petitionerJuned Alam and second bail application of petitioner-Mohd. Jaheer Alam, noting therein that petitioners have criminal antecedents of like nature. The fact that petitioners have criminal antecedents was not brought to the notice before the Co-ordinate Bench while the bail application was being argued. Taking note of the fact that this Court has dismissed the bail applications on account of criminal antecedents of the petitioners and also the fact that the case is at the final stage, I am not inclined to allow these bail applications.

The second bail application of petitioner No.1 and third bail application of petitioner No.2 is accordingly, dismissed.

However, trial Court is directed to dispose of the case at the earliest.
