The present bail applications have been filed under Section 439 Cr.P.C. on behalf of the petitioners, who are in judicial custody in connection with F.I.R. No.106/2021, Police Station Sadar Bhilwara, District Bhilwara, registered for the offences punishable under Sections 143, 323, 341, 307, 458, 427, 436 of Indian Penal Code & under Section 3/25 of Arms Act.

Heard learned counsel for the petitioners and learned Public Prosecutor. Perused the material available on record.

Learned counsel for the petitioners stated that except Mangilal, nobody has been named in the FIR; no injury has been found grievous in nature on any vital part of the body of the injured persons; no injury of the injured persons has been declared as dangerous to life; no recovery or investigation is pending against the accused-petitioners; trial of the case will take long time. With these submissions, learned counsel for the petitioners prayed that benefit of bail may be granted to the petitioners.

Per contra, learned Public Prosecutor opposed the bail applications and stated that one injury of injured Heeralal has been found grievous in nature and injury of injured Govind is simple in nature.

Having regard to the facts and circumstances of this case and particularly to the facts that injuries of injured Govind are simple and blunt in nature and sole injury of injured Heeralal has been found grievous in nature but the said injury is found on finger of the leg and not on vital part of the body and none of the

injuries have been declared as dangerous to life, therefore, without expressing any opinion on the merits/demerits of the case, this Court is of the opinion that the bail applications filed by the petitioners deserve to be accepted.

Consequently, the present bail applications are allowed. It is ordered that the accused-petitioners- (1) Mangi Lal son of Narain (2) Ankit Suthar son of Jagdish Chandra Suthar (3) Rishi Singh @ Pankaj Singh son of Radhey Singh and (4) Shubham son of Ghanshyam Harizan arrested in connection with F.I.R. No.106/2021, Police Station Sadar Bhilwara, District Bhilwara, shall be released on bail, if not wanted in any other case, provided each one of them furnishes a personal bond of Rs.50,000/- (Rupees Fifty Thousand) and two sureties of Rs.25,000/- (Rupees Twenty Five Thousand) each to the satisfaction of the learned trial Court for their appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
